Dear Director,
There is a debt dispute between our company Temprex LLP and Alexander Kuzin (personal code 36005230323). We make a request to you to render us an assistant under your possibility in decision of this question in compliance with legislation of Estonia.
Description of situation:
Alexander Kuzin persuaded company's Temprex LLP management that personally Alexander Kuzin successfully manages company Zircon Technologies AS and that company Zircon Technologies AS in the near future will have great profit from it's activity. But to reach success in business company Zircon Technologies AS needs turnover assets at the amount approximately 100 000 EUR. The assets needed for the short term.
Alexander Kuzin personally guaranteed to the company's Temprex LLP management that the loan will be repaid on time strictly according to the loan contract.
That is why there was the loan contract No. 2008/07/1785 was signed between companies Temprex LLP and Zircon Technologies AS on 23 July, 2008 with the personal guarantee of Alexander Kuzin. Alexander Kuzin as the director of Zircon Technologies AS company signed this contract on behalf of the company Zircon Technologies AS. that is, Alexander Kuzin guaranteed that company Zircon Technologies AS under the direction of Alexander Kuzin will fairly return borrowed money and will pay interest for using the loan.
According to this contract company Temprex LLP provided loan to the company Zircon Technologies AS for the amount of 106 000.00 EUR.
According to the aforesaid contract (paragraph 3) Zircon Technologies AS company has to pay interest for using the loan monthly. Company Temprex LLP regularly billed invoices for loan interest. Company Zircon Technologies AS hasn't ever paid interest. Company's Zircon Technologies AS debt for payment of interest and fines for not paying interest for using the loan on 04 September, 2009 is 8 053.51 EUR.
Company Zircon Technologies AS borrowed loan sum (106 000.00 EUR) was obliged to return to the company Temprex LLP until 31 July, 2009 (paragraph 5 of the contract). Company Zircon Technologies AS hasn't returned any money.
Now Alexander Kuzin do not answer letters and appeals of the Lender - Company Temprex LLP, does not communicate, ignores all attempts to discuss the problem.
We offer you to find the way to persuade Alexander Kuzin to complete undertaken obligations and to return 106 000.00 EUR loan in the shortest term and to discharge the indebtedness for using the loan at the amount of 8 053.51 EUR. According to our data, the debtor has enough funds to repay the debt.
We are ready to consider all arrangements offered by you, which are aimed at elimination of debt to us (collection and returning of money to us, sale of debt by us (right of debt demand), etc.).
We are ready to consider any of your suggestions about payment for Your services.

Уважаемый Господин Руководитель.
У нашей компании - Temprex LLP - имеется долговой спор с Александром Кузиным (личный код 36005230323). Обращаемся к Вам с предложением оказать нам в рамках Ваших возможностей помощь в решении этого вопроса в соответствии с законодательством Эстонии.
Описание ситуации:
Александр Кузин убедил руководство компании Temprex LLP в том, что лично Александр Кузин успешно руководит компанией Zircon Technologies AS и что у компании Zircon Technologies AS в ближайшее время будет большая прибыль от деятельности. Однако, для достижения успеха в бизнесе, компании Zircon Technologies AS нужны оборотные средства в размере около 100 000 евро. Средства нужны на короткий срок.
Александр Кузин лично гарантировал руководству Компании Temprex LLP, что кредит будет возвращен вовремя в строгом соответствии с договором кредита.
Поэтому, между компанией Temprex LLP и компанией Zircon Technologies AS под личные гарантии Александра Кузина был заключен договор кредита №2008/07/1785 от 23 июля 2008 г. Александр Кузин, как руководитель компании Zircon Technologies AS, подписал этот договор со стороны компании Zircon Technologies AS. То есть, Александр Кузин гарантировал, что компания Zircon Technologies AS под руководством директора Александра Кузина честно вернет взятые в долг деньги и заплатит проценты за пользование кредитом.
В соответствии с этим договором компания Temprex LLP предоставила компании Zircon Technologies AS кредит в сумме 106 000,00 Евро.
По условиям вышеназванного договора (пункт 3.) компания Zircon Technologies AS обязана ежемесячно платить проценты за использование кредита. Компания Temprex LLP регулярно выставляла счета на оплату процентов по кредиту. Компания Zircon Technologies AS проценты ни разу не заплатила. Задолженность компании Zircon Technologies AS по оплате процентов и пеней за неоплату процентов за использование кредита на 04.09.2009 г. составляет 8 053,51 Евро.
Компания Zircon Technologies AS одолженную сумму кредита (106 000,00 Евро) обязана была вернуть компании Temprex LLP до 31 июля 2009 года (пункт 5. договора). Компания Zircon Technologies AS ни одного Евро не вернула.
Теперь Александр Кузин на письма и обращения Кредитора - Компании Temprex LLP - не отвечает, на связь не выходит, все попытки обсудить проблему игнорирует.
Предлагаем Вам найти способ убедить Александра Кузина выполнить взятые на себя обязательства и в кратчайшие сроки вернуть 106 000,00 Евро кредита и погасить задолженность в размере 8 053,51 Евро за пользование кредитом. По нашим данным, средства, достаточные для возврата задолженности, у должника имеются.
Готовы рассмотреть любые предложенные Вами меры, направленные на ликвидацию задолженности перед нами (взыскание и возврат нам денег, продажа нами долга, то есть права требования долга и т.д.).
